Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Chair Six ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. You may not impersonate another person or create multiple accounts to circumvent enforcement actions.

4. User Content

You retain ownership of content you post (photos, videos, text, ski run data). By posting content, you grant Chair Six a non-exclusive, royalty-free, worldwide license to host, display, and distribute that content within the App to other users in accordance with your chosen visibility settings.

You may delete your content at any time. Deleted content is removed from our servers within 30 days, except where retention is required by law.

5. Prohibited Conduct

You agree not to:

• Post content that is illegal, obscene, threatening, defamatory, or that promotes violence or discrimination
• Harass, bully, stalk, or intimidate other users
• Post sexually explicit or exploitative material
• Spam, advertise, or solicit without permission
• Impersonate another person or entity
• Attempt to access another user's account
• Upload malware or interfere with the App's infrastructure
• Use the App to track another person's location without their consent
• Scrape, crawl, or collect data from the App by automated means

Chair Six has zero tolerance for objectionable content or abusive users. Violations may result in immediate account termination without notice.

6. Content Moderation

We may review, remove, or restrict access to any content that violates these Terms or that we determine, in our sole discretion, is harmful to the community. Users can report objectionable content or block other users at any time. We strive to review reports promptly but do not guarantee specific response times.

7. Privacy

Your use of the App is also governed by our Privacy Policy. Key points:

• GPS location is collected only while you actively track a ski run. We never track your location in the background without your knowledge.
• Direct messages are private between you and the recipient.
• We do not sell your personal data to third parties.
• We do not use your data for advertising.
• You control who can see your location, stats, and activity through Privacy Settings.

8. Intellectual Property

The App, including its design, code, logos, and branding, is owned by Chair Six and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

9. Ski Safety Disclaimer

Chair Six is a social and tracking tool — it is not a safety device. You are solely responsible for your safety while skiing or snowboarding. Do not use the App in a way that distracts you or endangers yourself or others on the mountain.

Speed, vertical, and distance data are approximate and derived from GPS, which can be inaccurate. Do not rely on the App for navigation, avalanche safety, or emergency purposes.

Chair Six is not responsible for any injury, loss, or damage arising from skiing, snowboarding, or outdoor activities.

10. Account Deletion

You may delete your account at any time from the Privacy Settings or Profile screen. Deletion permanently removes your profile, posts, comments, messages, ski runs, and all associated data. This action cannot be undone.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, without prior notice. Upon termination, your right to use the App ceases immediately.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

To the maximum extent permitted by law, Chair Six and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, personal injury, or property damage.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify users of material changes through the app.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
